Terms of Use and Sale
Plain-English summary: ClipDesk is a physical product with no software, so there is no software license (EULA). These terms cover using this site and buying a ClipDesk. Please also read our Safety, Shipping and returns, and Privacy pages.
1. Who we are
ClipDesk is operated by Aidan Piecuch, a sole proprietor based in California, United States ("ClipDesk", "we", "us"). You can reach us at hello@getclipdesk.com or on Instagram at @clipdeskofficial.
2. Agreeing to these terms
By using this site or buying from us, you agree to these terms. If you do not agree, do not use the site or place an order. You must be at least 18, or have a parent or guardian's permission, to buy from us.
3. Orders and pricing
- Prices are in US dollars. Shipping within the United States is free. Sales tax is added where required.
- We ship only within the United States.
- Payments are handled by a third-party payment processor. We never see or store your full card number.
- We may refuse or cancel an order, for example because of a pricing error, suspected fraud, or lack of stock. If we cancel after you paid, we refund you in full.
- An order is accepted when we email you a shipping confirmation.
4. Product use and safety
ClipDesk is designed to extend a solid desk surface for a laptop and light items, up to the load limit of 30 lb (13.6 kg). Use it only as described on our Safety page and on the card in the box. You are responsible for checking that the clamp fits your desk and is tight before each use, and for following the rules of the place where you use it.
5. Warranty
We do not offer a separate written warranty beyond our 30-day return policy in Shipping and returns. To the extent the law allows, ClipDesk is sold "as is" apart from that policy. Some places do not allow limits on implied warranties, so this may not apply to you, and nothing here limits any rights you have under consumer protection laws.
6. Limitation of liability
To the fullest extent the law allows, ClipDesk is not liable for indirect, incidental, special, or consequential damages, or for damage to laptops, devices, desks, furniture, or other property, arising from misuse of the product, exceeding the load limit, or use that does not follow our instructions. To the fullest extent the law allows, our total liability for any claim is limited to the amount you paid for the product. Nothing in these terms limits liability that cannot legally be limited, including for personal injury caused by our negligence, fraud, or anything else the law does not let us exclude.
7. Intellectual property
The ClipDesk name, logo, product design, photos, text, and other content on this site belong to us or our licensors. You may view the site and share links to it. You may not copy, scrape, resell, or use our name, logo, or content for commercial purposes without our written permission. See Copyright and trademarks.
8. Acceptable use
Do not use the site to break the law, interfere with it or its security, scrape it with automated tools, or submit false information. We may block access if you do.
9. Third-party links and services
This site links to services we do not control, such as Instagram and our payment processor. Their terms and privacy practices apply to your use of them.
10. The site is provided as is
We work to keep the site accurate and available, but we do not promise it will be error-free or always online. Product photos and the 3D model on the site are illustrations and may differ slightly from the final product.
11. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. If you have a problem, please contact us first at hello@getclipdesk.com so we can try to fix it. If we cannot resolve it, disputes will be handled in the state or federal courts located in San Diego County, California, unless the law gives you the right to bring a claim somewhere else.
12. Changes
We may update these terms. The date at the top shows the latest version, and the version in effect when you place an order applies to that order.
13. General
If a part of these terms is found unenforceable, the rest stays in effect. These terms, together with the pages linked above, are our full agreement with you about the site and your purchase.
